These Terms & Services ("Terms") govern your access to and use of the MariaDad Health website located at jmariadaddpm.com (the "Site"), related patient portals linked from the Site, membership programs, appointment request tools, educational content, and any other services we provide (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to submit forms or enroll in membership programs through the Site. If you use the Services on behalf of another person, you represent that you have legal authority to bind that individual to these Terms and to consent to collection of their health-related information as described in our Privacy Policy.
You are responsible for maintaining the confidentiality of any portal credentials issued to you and for all activity that occurs under your account. Notify us immediately through the contact form if you suspect unauthorized access.
Information on the Site — including blog articles, FAQs, pricing summaries, and downloadable materials — is provided for general educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with questions regarding a medical condition. Never disregard professional advice or delay seeking care because of something you read on the Site.
Clinical services are delivered only through licensed professionals during established patient relationships and approved care settings. Submitting an appointment request or contact form does not create a provider-patient relationship until confirmed by our clinical team according to applicable regulations and internal policies.
Online appointment forms express your interest in a visit time. Submission does not guarantee availability. A coordinator will contact you to confirm date, time, location or telehealth modality, and any preparation instructions. You agree to provide accurate contact information and to arrive prepared with relevant medical history, medication lists, and insurance details when applicable.
Missed appointments or late cancellations may be subject to fees disclosed during confirmation or in membership materials. Repeated no-shows may result in limitations on online scheduling privileges.
Membership tiers described on the Pricing Plan page outline included services, support hours, and recurring fees. Fees are billed according to the cycle selected at enrollment. Benefits renew monthly unless cancelled in accordance with plan rules. Membership fees are separate from insurance copayments, deductibles, or charges for services not included in your tier.
We may modify plan features or pricing with reasonable advance notice. Continued use after the effective date of changes constitutes acceptance unless you cancel before the new rate applies. Refunds, when offered, follow the policy communicated at enrollment.
When telehealth is offered, you agree to participate from a private location with adequate connectivity. You understand that technical failures may require rescheduling and that telehealth is not appropriate for all conditions, particularly emergencies. Clinicians may direct you to in-person evaluation when medically necessary.
You agree not to:
We may suspend or terminate access for conduct that jeopardizes security, other users, or our staff.
The Site design, logos, text, graphics, and software are owned by MariaDad Health or licensed to us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to view and print content for personal, non-commercial use. Trademarks displayed on the Site may not be used without prior written consent.
The Site may link to external resources such as social networks or payment processors. We do not control and are not responsible for third-party content or privacy practices. Your use of third-party services is governed by their terms.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARIADAD HEALTH AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US FOR MEMBERSHIP IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
You agree to indemnify and hold harmless MariaDad Health from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or infringement of another party's rights.
Our collection and use of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to those practices.
By submitting forms or subscribing to email updates, you consent to receive transactional messages related to your requests. Marketing emails include unsubscribe options as described on our Unsubscribe page. Message and data rates may apply for SMS if offered and opted into separately.
We may update these Terms periodically. Material changes will be indicated by updating the "Last updated" date and, when appropriate, by notice on the Site. Your continued use after changes become effective constitutes acceptance.
These Terms are governed by applicable laws without regard to conflict-of-law principles. Parties agree to attempt good-faith resolution of disputes through direct communication before pursuing formal remedies. Where permitted, you and MariaDad Health may agree to binding arbitration on an individual basis, waiving class actions to the extent allowed by law.
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any plan-specific agreements you accept, constitute the entire agreement regarding use of the Site and supersede prior understandings on the same subject.
Questions about these Terms may be submitted through our Contact Us form or by email to care@jmariadaddpm.com.
